Discrimination Alleged Against Muslim Schools in Texas Education Support Programme

The largest private school support program in the United States, planned for implementation in Texas for the upcoming school year, has excluded Muslim schools from participation. In a lawsuit filed by a parent whose child attends an Islamic school, it is alleged that state officials’ decision to exclude Islamic private schools from the program constitutes religious discrimination.

The Texas Education Freedom Accounts (TEFA) program, which opened applications about a month ago, provides state-funded education savings accounts that families can use to send their children to private schools. Under the program, families receive an average of $10,000, while students with disabilities may receive up to $30,000, and homeschool students up to $2,000. The program has been allocated a total budget of $1 billion over the next two years.

The parent who filed the lawsuit against the state on the grounds of religious discrimination is Mehdi Cherkaoui, a lawyer whose children attend an Islamic private school in Houston. In the complaint, Cherkaoui states that although hundreds of private schools across the state have been approved to participate in the program, no accredited Islamic private school has been included. The lawsuit names Texas Attorney General Ken Paxton, Acting Comptroller Kelly Hancock, who administers the program, and Education Commissioner Mike Morath as defendants.

State officials, however, argue that the program does not involve religious discrimination. Authorities claim that some schools were excluded due to concerns that they could have links to terrorist organizations or foreign adversaries. At the center of the controversy is the fact that some Islamic schools are accredited by an organization that previously hosted events associated with the Council on American-Islamic Relations (CAIR).

According to experts, school choice programs have expanded rapidly across the United States in recent years, but they have also frequently sparked debates over equal access and discrimination. Education policy researchers emphasize the importance of strong anti-discrimination safeguards in programs that use public funds.
