Can AI Chatbot Conversations Be Used as Evidence in Court?
In several recent criminal cases in the United States, conversations suspects had with AI chatbots such as ChatGPT have been brought into court as critical pieces of evidence. A man accused of killing two university students in Florida allegedly asked ChatGPT questions about disposing of a human body in the days before the murders. Similar evidence played a significant role in the Los Angeles wildfires arson case and a 2024 murder trial in Virginia. According to experts, these developments are a sign that as AI platforms rapidly become integrated into everyday life, they are also beginning to directly shape the course of legal proceedings.
Under the current legal framework, conversations held on AI chat applications do not benefit from the confidentiality protections that apply to attorney-client or doctor-patient relationships; legally, they are treated as equivalent to credit card records or phone call logs. OpenAI CEO Sam Altman himself publicly acknowledged this as a ‘‘huge issue’’, noting that users share deeply personal and sensitive information with ChatGPT, yet the company could be required to produce that data in the event of a lawsuit. Cybersecurity experts, meanwhile, point out that suspects often ask unusually direct and straightforward questions, operating under the mistaken belief that their interactions with AI will remain undisclosed.
The legal dimensions of the issue have begun to be debated not only through the lens of individual criminal cases, but on a broader institutional and societal scale. Florida’s attorney general launched a formal criminal investigation into OpenAI, alleging that ChatGPT provided significant advice to the suspect in a mass shooting, while in Canada, families of victims of a school shooting filed a lawsuit against the company. Some experts advocate for extending a legal privilege to AI conversations similar to those that exist in medicine or law, while others question whether the existing legal framework could accommodate such protections. As AI chatbots carry greater weight in public life, the question of how the legal status of data shared on these platforms will take shape remains an open one for users and policymakers alike.
